Things that surprise people moving out of Florida

  • Real estate licensing is state by state. An agent licensed in Florida cannot represent you in Utah, and a Utah licensee cannot represent you in Florida.
  • Sale prices in Utah are not a matter of public record — it is one of a minority of non-disclosure states. Coming from Florida, where documentary stamps on the deed make the number effectively public, expect to lean far harder on your agent for comparables than you are used to.
  • Leaving Florida means picking up a state income tax in Utah. Model it against the housing number before you settle on a price range, and take the actual arithmetic to a tax adviser rather than to any real estate agent, including me.
  • Closings in Utah generally run through a title or escrow company rather than requiring an attorney as a matter of course — structurally closer to what you are used to in Florida than not.
  • Florida’s homestead exemption and its Save Our Homes assessment cap do not follow you. Utah has its own property tax treatment, its own exemptions, and its own rules on how fast an assessment may rise. Confirm the specifics with the local taxing authority.

The process, in three steps

A first purchase, a downsize, an investment, a relocation with a company behind it — these need genuinely different agents, and the difference is not obvious from a profile page.

Where Orem supports it I would rather hand you two options than one. A referral that gives you no choice is just a redirect.

Nothing is owed either way

If you take a name and never call it, that is a fine outcome. No fee arises unless a transaction actually closes, so nothing about this obliges you.

Where my licence stops

Two closings in two states means two contracts, two sets of local custom and two lenders’ calendars, and no single person has authority over both. What can be arranged is that each side knows what the other is waiting on. If I am handling a Florida sale for you, I will tell your Utah agent what my dates look like and I will ask for theirs. Where those calendars are never introduced to each other, the result is usually a rent-back nobody planned for or interim financing nobody budgeted for.

What I would ask if I were you

  • Can I sign remotely — electronically, or by post — or does something have to happen in person? If I am still in Florida on the day, what does that change?
  • If my timeline slips by six weeks, what happens to the agreement I am about to sign with you, and what happens to any money already committed?
  • What is the local practice on possession — do I get the keys at closing, or do sellers here commonly stay on for a period afterwards, and how is that documented?
  • Have you worked with buyers who were selling in another state at the same time? Ask for the mechanics of how they handled it rather than for a reassurance that they have.

The limits, stated outright

I will not tell you what to offer or what to ask in Orem. Pricing is the advisory half of brokerage, it rests on evidence I have no proper access to, and giving it where I hold no licence would be the precise thing this page says I do not do. When you want that answer, take it from the licensee I introduce you to, in writing, with the comparable properties attached to it.

One move, two transactions

If you already have a Florida agent you trust, keep them. The referral stands on its own and does not require you to move your Florida business to me. Tell me on the first call and I will make the introduction and step back out of it. That is a shorter conversation than the other one, and it costs you exactly the same, which is nothing.

What do you actually tell the agent about me?

The shape of the transaction. The city, roughly when, buying or selling, and anything you have told me matters to you in how you are dealt with. Not your finances, and nothing you have asked me to keep to myself. If you would rather I said less than that, say so — it is your information, and a shorter briefing costs nothing.

How is this different from the sites that match me with an agent?

Put the same two questions to any of them and compare the answers: how many people receive my details, and who pays you. Here the answers are one named brokerage, and the receiving brokerage pays The Keyes Company a share of its own commission if a transaction closes. Neither arrangement is illegitimate. They are simply not the same thing, and you are entitled to know which one you are in.

Can you represent me in Orem?

No. My licence is issued by Florida and is valid in Florida only. Representing you in a Utah transaction would be unlicensed activity there. What I can do is refer you to a licensee in Utah through The Keyes Company.

What does a referral cost me?

Nothing. You are not charged for a referral. If a referred transaction closes, a referral fee may be paid between the two brokerages out of the commission on that transaction. It does not increase what you pay.

Who actually pays you?

Only my broker can. Under Section 475.42(1)(d), Florida Statutes, a sales associate may be compensated only by the registered broker. Any referral fee is paid to The Keyes Company, and The Keyes Company may in turn compensate me. There is no direct payment from you or from the Utah agent to me.

The brokerage on the other end

You will notice nobody is named below. That is deliberate and it is temporary: I would rather show you an empty list than a borrowed one.

In practice: The Keyes Company places the referral, and I go looking for a licensee whose recent work resembles what you are about to do. A first-time purchase, a downsize and an investment buy need genuinely different people, and that difference is invisible from a profile page.

Three things stay true whoever it turns out to be:

  • They will hold a current licence in the state where your transaction happens, and they will represent you under that state’s law — not under Florida’s, and not under mine.
  • Any referral fee is paid brokerage to brokerage, out of the commission on a closed transaction. It costs you nothing and it does not increase what you pay. Under Section 475.42(1)(d), Florida Statutes, any share reaching me comes from my broker and from nowhere else.
  • You are under no obligation to use them. Interview them, interview someone else, or decline entirely. If the fit is wrong, tell me and I will go back and look again.

As referral relationships are formalised, the brokerages involved will be named here, together with their licence number and the regulator that issued it, so you can verify them yourself rather than take my word for it.
